Green Haven Gardening Services offers professional landscaping, garden maintenance, lawn care, and related services as described on our website and service agreements.

2.1 Service Agreements

All services are provided pursuant to a written or digital service agreement that specifies:

2.2 Changes to Services

We reserve the right to modify, suspend, or discontinue any service at any time with notice to clients. Seasonal changes, weather conditions, and plant availability may necessitate changes to scheduled services.

3. Client Responsibilities

To ensure we can provide the best possible service, clients agree to:

Provide safe and unobstructed access to the areas requiring service. This includes securing pets, removing obstacles, and informing us of any potential hazards on the property.

3.2 Water Availability

Ensure outdoor water sources are functional and accessible for our team when water-dependent services are scheduled.

3.3 Disclosure of Conditions

Inform us of any underground utilities, irrigation systems, or special considerations (such as protected plant species) before service begins.

4. Pricing and Payment Terms

4.1 Quotes and Estimates

All quotes are valid for 30 days from the date of issue. Quotes are based on current market prices for materials and labor and may be subject to change if the project scope changes or if there are significant delays in project commencement.

4.2 Payment Schedule

For larger projects, a deposit may be required before work begins. Final payment is due upon completion of services unless otherwise arranged in writing. Regular maintenance clients will be billed on a monthly or seasonal basis as specified in their service agreement.

4.3 Late Payments

Accounts not paid within 30 days of invoice date may be subject to a late fee of 1.5% per month (18% annually) on the outstanding balance. Services may be suspended for accounts with payments overdue by 60 days or more.

5. Cancellation and Rescheduling Policy

5.1 Service Cancellation

Clients may cancel scheduled services with at least 48 hours notice without penalty. Cancellations with less than 48 hours notice may be subject to a cancellation fee of up to 50% of the service cost.

5.2 Weather-Related Cancellations

We reserve the right to reschedule services due to inclement weather or unsafe working conditions. In such cases, we will contact you to arrange a new service date.

5.3 Contract Termination

Either party may terminate ongoing service agreements with 30 days written notice. Clients remain responsible for payment for all services rendered up to the termination date.

6. Plant Guarantee

We guarantee all plants installed by our team for 90 days from installation against failure to establish, provided that:

  • The client follows our watering and care instructions
  • Plant failure is not due to extreme weather conditions, animal damage, or neglect
  • We are notified of the plant failure within the guarantee period

This guarantee covers replacement of the plant only, not additional labor costs unless otherwise specified.

7. Liability Limitations

7.1 Property Damage

While we exercise utmost care in performing our services, we are not liable for damage to irrigation systems, underground utilities, or other property features that were not properly identified prior to service commencement.

7.2 Pre-Existing Conditions

We are not responsible for pre-existing plant diseases, pest infestations, or other garden problems that were not caused by our services.

7.3 Maximum Liability

Our maximum liability for any claim relating to our services is limited to the total amount paid by the client for those specific services.

8. Intellectual Property

All landscape designs, plant lists, and garden plans created by Green Haven Gardening Services remain our intellectual property, even when implemented on client properties. Clients receive a license to use these designs for their property but may not reproduce or reuse them for other purposes without our written permission.

9. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after any changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state where our primary business is located, without regard to its conflict of law provisions.
